Rock-N-Roll Night

I've been down but never
been this down before.
I've been to the Kingdom
but never come to this locked door.

This my admission
I miss your heart.
Beating near mine
I need you in my part.

Deep down in this Rock-N-Roll Night
Deep down where the swamp things bite.
Deep down in this Rock-N-Roll Night
Oh... in this night.

I been alone
but never been this lonesome as before.
I stood on the street
while you played his little whore.

My final solution
crush this heart of stone.
Beating near mine
my rose taken... both alone.

Deep down in this Rock-N-Roll Night
Deep down where the swamp things bite.
Ah... 1985 night.
1985 Rock-N-Roll Night.

I been down
never been this down before.
This is my admission.
Down in...
This Rock-N-Roll Night.
This Rock-N-Roll Night.

If you actually made any money on this, you'd be sued for plagiarism.

Little Feat, Linda Ronstadt and Bonnie Raitt would beat you to a bankrupt
pulp.

They'd lose the lawsuit though if they did try that.

Your false statement and misrepresentation was when you tried to smear me as
a plagiarist on my song:

Which you've probably checked out by now and no there's no connection to any
of the other works you hinted at... so fine, we can let it drop.

Really? Based on what evidence? Have you actually looked at the history
of successful lawsuits involving these matters? If you did and understood
what you read, you'd already be revising that line.

I idn't call you a plagiarist, I said if you actually made any money on
it you would be sued for basically lifting a line from a very popular
song.

I'm not the land shark from any interested party but if I was and you
made any serious money, you'd be sued because that's the job and duty of
the said land shark.

I just did a Google search for the line "Ive been down but never been this
down before..." and there are no matches for those exact words. How could I
be successfully sued for lines I wrote that no other song seems to have
exactly as I wrote them?

Similar counts in this type of lawsuit, Will. Like I said, look it up
yourself since you won't believe me. After listening to your song, I'm
inclinded to believe they may sue you only because it implied it's a bad
version of their material.

Also note the placement of the line in each song.

I did say I actually believe you consciously didn't set out to rip off
the song. So settle down, Beavis. Kluckwheat finally croaks and you feel
a need to replace the liar as the group's Drama Queen so soon? Give it a
fucking rest and wait until his cardboard coffin collapses and the worms
get their fill first.

Okay, I'll definitely do some looking... and as a matter of fact, I think
this was the problem John Lennon wound up having with Chuck Berry with "Come
Together", where just about the only similarity in their two songs was
something like "Here comes old Flat Top..."

So you could be right, and if you are... then many of /my/ arguments on
usage in poetry and lyrics also may be turning out correct aftre all, as
well.

More on that later, and thanks, really... and Happy Thanksgiving to you and
yours, Cujo!
